Terms of service

TERMS OF SERVICE

Effective Date: September 7, 2026

Welcome to HomeSpark. These Terms of Service (“Terms”) establish the conditions that apply when you visit our online store, browse merchandise, place an order, make a purchase, or use services made available through HomeSpark.

Throughout these Terms, “HomeSpark,” “we,” “us,” and “our” refer to HomeSpark. “You,” “your,” and “customer” refer to any visitor, purchaser, or other user of our online store.

By accessing our website or submitting an order, you agree to these Terms together with the policies and product-specific information applicable to your transaction.

1. HOMESPARK RETAIL SERVICES

HomeSpark operates an online retail store that may offer merchandise for the home and everyday living, including household accessories, décor, organization products, kitchen or dining accessories, lifestyle merchandise, gifts, and other consumer goods.

Our product assortment may evolve over time.

2. POLICIES THAT APPLY TO YOUR ORDER

These Terms operate together with other HomeSpark policies, including our:

Privacy Policy;
Shipping Policy;
Return & Refund Policy; and
Any product-specific terms or promotional conditions presented before purchase.

Customers should review all applicable information before completing checkout.

3. ELIGIBILITY TO PURCHASE

You must have sufficient legal capacity under applicable law to enter into a purchase transaction.

Individuals below the applicable age of majority should make purchases only with appropriate authorization or involvement from a parent or legal guardian where required.

4. SHOPPING RESPONSIBILITIES

Customers are responsible for reviewing merchandise information before ordering.

For home and household products, this may include checking:

Dimensions;
Materials;
Capacity;
Weight;
Color or finish;
Intended location;
Assembly requirements;
Compatibility;
Care instructions; and
Safety information.
5. PRODUCT DESCRIPTIONS

HomeSpark makes reasonable efforts to provide useful and accurate descriptions of merchandise.

Information may be based partly on details supplied by manufacturers, distributors, or suppliers.

We may update product information when specifications or other details change.

6. PRODUCT PHOTOGRAPHY

Product photographs are intended to help customers evaluate merchandise.

Actual colors, textures, patterns, finishes, proportions, or surface characteristics may vary slightly due to photography, lighting, screen settings, device displays, manufacturing processes, or material characteristics.

Minor non-material variations do not necessarily constitute defects.

7. DIMENSIONS AND SPACE PLANNING

Customers should carefully review available measurements before purchasing products intended for a particular room, cabinet, shelf, counter, storage area, or other space.

Measurements may be approximate unless expressly identified otherwise.

HomeSpark is not responsible for a customer's failure to measure an intended space accurately, subject to rights available under applicable law.

8. MATERIAL AND FINISH VARIATIONS

Certain materials may naturally exhibit differences in grain, shade, texture, pattern, or finish.

Products containing wood, woven fibers, stone-like materials, ceramics, glass, metals, printed materials, or handmade components may therefore differ slightly between individual units.

These characteristics may be normal rather than defects.

9. PRODUCT SETS AND COMPONENTS

Some merchandise may be sold as sets or contain multiple pieces.

Customers should review product descriptions to determine what is included.

Accessories, furniture, decorative objects, or other items appearing in photographs for staging purposes are not included unless the applicable listing expressly states otherwise.

10. ASSEMBLY REQUIREMENTS

Certain HomeSpark products may require assembly, installation, mounting, adjustment, or setup.

Customers should follow all instructions provided with the merchandise.

Assembly should not be attempted in a manner inconsistent with the manufacturer's instructions or applicable safety guidance.

11. INSTALLATION

Where installation requires specialized tools, electrical work, plumbing, structural mounting, or other technical skills, customers should use an appropriately qualified professional where reasonably necessary.

HomeSpark does not represent that every product is suitable for do-it-yourself installation.

12. WALL, SURFACE, AND LOCATION SUITABILITY

For products intended to be mounted, attached, placed, or installed on a particular surface, customers are responsible for evaluating whether the location and supporting materials are appropriate.

Wall construction, anchors, fasteners, surface materials, weight limits, and installation methods may affect suitability and safety.

13. PRODUCT CAPACITY AND LOAD LIMITS

Where a product includes a stated weight, load, volume, or capacity limitation, customers should not exceed that limitation.

Improper loading or use may result in damage or create a safety hazard.

14. HOUSEHOLD PRODUCT SAFETY

Customers should follow applicable warnings, instructions, and safety information accompanying household merchandise.

Products should be kept away from children, pets, heat, moisture, open flames, or other hazards where the applicable instructions require such precautions.

15. CARE AND CLEANING

Products should be cleaned, maintained, and stored according to applicable instructions.

Certain finishes and materials may be damaged by abrasive cleaners, excessive moisture, harsh chemicals, prolonged sunlight, heat, or improper storage.

Damage resulting from inappropriate care may not constitute a defect, subject to applicable law.

16. INTENDED USE

Merchandise should be used only for its intended or reasonably foreseeable purpose.

Products intended for decorative use should not be treated as functional equipment unless the applicable listing indicates otherwise.

Customers should not modify products in ways that materially compromise their safety or intended functionality.

17. PRODUCT PACKAGING

Manufacturers or suppliers may update product packaging, labeling, inserts, or presentation.

Packaging received may therefore differ from website photographs while the underlying merchandise remains materially equivalent.

This provision does not restrict rights relating to materially incorrect products.

18. MERCHANDISE AVAILABILITY

Products are offered subject to inventory availability.

Placing merchandise in a cart does not permanently reserve it.

Inventory may change before fulfillment because of customer demand, supplier availability, inventory adjustments, or other operational circumstances.

If paid merchandise cannot be fulfilled, any amount owed will be refunded.

19. QUANTITY RESTRICTIONS

HomeSpark may establish reasonable purchase limits for particular merchandise, promotions, customers, accounts, households, or transactions.

We may reduce or cancel quantities exceeding an applicable limit.

Amounts owed for canceled paid merchandise will be refunded.

20. PRODUCT PRICES

Prices may change for future transactions.

Customers should review the applicable price during checkout.

The amount properly presented when an order is submitted will generally govern that transaction, subject to correction of genuine errors where permitted by applicable law.

21. TAXES AND ORDER CHARGES

The final amount displayed during checkout may include:

Merchandise charges;
Applicable sales taxes;
Shipping charges;
Promotional discounts; and
Other amounts disclosed before payment.

Customers should review the complete total before submitting the transaction.

22. SALES, COUPONS, AND PROMOTIONS

HomeSpark may periodically provide sales, promotional codes, bundles, or other special offers.

Promotions may be subject to conditions regarding:

Eligible products;
Minimum purchase values;
Expiration dates;
Redemption limits;
Customer eligibility; and
Combination with other discounts.

Expired, altered, fraudulent, duplicated, or unauthorized promotional use may be rejected.

23. CORRECTION OF STORE INFORMATION

Despite reasonable efforts, errors may occasionally occur in prices, descriptions, inventory, measurements, photographs, promotions, or other store information.

HomeSpark may correct genuine errors when discovered.

If a material error affects an unfulfilled transaction, we may provide corrected information or cancel the affected merchandise where appropriate.

Any amount owed following cancellation will be refunded.

24. SUBMITTING AN ORDER

Completing checkout represents your request to purchase the merchandise identified in the order.

An automated confirmation generally acknowledges that our system received the request.

It does not necessarily guarantee final acceptance or fulfillment of every item.

25. ORDER ASSESSMENT

Before fulfillment, HomeSpark may reasonably verify:

Product availability;
Payment authorization;
Billing details;
Shipping information;
Order quantities; and
Transaction security.

We may request additional information when reasonably necessary to process an order.

26. ORDER ACCEPTANCE OR CANCELLATION

We may decline, hold, or cancel an order for legitimate reasons.

These may include:

Product unavailability;
Payment failure;
Material pricing or listing errors;
Incomplete customer information;
Reasonable fraud concerns;
Unauthorized payment activity;
Shipping restrictions; or
Applicable legal requirements.

If a paid order is canceled, any amount owed will be refunded.

27. CUSTOMER INFORMATION

Customers are responsible for providing accurate and complete transaction information.

Please verify your:

Name;
Email address;
Telephone number where requested;
Billing information;
Delivery address; and
Payment details.

If you identify an error, contact HomeSpark promptly.

Corrections cannot be guaranteed after fulfillment begins.

28. PAYMENT

Payment methods available for a transaction are displayed during checkout.

By providing payment information, you represent that you are authorized to use the selected method and authorize the applicable charge.

Independent payment processors and financial institutions may participate in processing transactions.

29. TRANSACTION VERIFICATION

We may use reasonable procedures intended to prevent fraudulent or unauthorized purchases.

Orders presenting legitimate security concerns may be held temporarily for verification.

Customers must not knowingly submit unauthorized payment credentials, false billing information, or information intended to circumvent transaction-security measures.

30. SHIPPING

Our separate Shipping Policy governs order processing and shipment.

Customers should review that policy for information concerning applicable:

Processing periods;
Shipping services;
Shipping charges;
Estimated transit times; and
Geographic delivery limitations.
31. DELIVERY TIMEFRAMES

Unless expressly identified as guaranteed, delivery dates and transit periods are estimates.

Weather, carrier operations, holidays, transportation interruptions, seasonal demand, address issues, or circumstances outside our reasonable control may affect delivery.

32. DELIVERY ADDRESS

Customers are responsible for providing a complete and accurate shipping address.

If you identify an address error after ordering, contact HomeSpark promptly.

We may attempt to correct eligible information before shipment, but changes cannot be guaranteed after fulfillment or carrier processing begins.

33. LARGE OR MULTI-PIECE ORDERS

Where an order contains multiple products or packages, merchandise may arrive separately.

Different packages may receive separate tracking information or delivery dates.

Receipt of one package does not necessarily mean the entire order has been delivered.

34. MODIFYING AN ORDER

Customers may request an order modification before fulfillment has advanced too far.

Depending on processing status, we may be unable to change:

Products;
Variants;
Quantities;
Customer information; or
Delivery details.

A requested modification is effective only when confirmed by HomeSpark.

35. CANCELLATION REQUESTS

Customers may request cancellation while fulfillment can reasonably be stopped.

A cancellation request does not guarantee that cancellation will be possible.

Once merchandise has shipped, available options will generally be governed by our Return & Refund Policy.

36. RETURNS AND EXCHANGES

Return and exchange eligibility is governed by our separate Return & Refund Policy.

Depending on the merchandise, return requirements may address:

Applicable deadlines;
Product condition;
Original packaging;
Included components;
Tags or labels;
Assembly status; and
Proof of purchase.

Nothing in these Terms limits mandatory consumer protections that cannot legally be waived.

37. ASSEMBLED, INSTALLED, OR USED PRODUCTS

Where permitted by applicable law, return eligibility may be affected if merchandise has been materially assembled, installed, mounted, modified, used, washed, damaged, or otherwise altered after delivery.

Customers should inspect products before significant assembly or installation whenever reasonably possible.

Specific return conditions are stated in our Return & Refund Policy.

38. REFUND PROCESSING

Approved refunds are processed according to our Return & Refund Policy.

Where appropriate, refunds will generally be issued through the applicable original payment method.

Banks, card issuers, and other payment providers may require additional time to post funds after we submit a refund.

39. DAMAGED OR INCORRECT MERCHANDISE

Customers should inspect merchandise reasonably promptly after delivery.

If a product arrives damaged, defective, incomplete, or materially different from what was ordered, please contact HomeSpark.

We may reasonably request:

Your order number;
A description of the problem;
Photographs of the merchandise;
Photographs of packaging; and
Photographs showing damaged components where relevant.

Available remedies will be determined under our policies and applicable law.

40. DAMAGE DURING ASSEMBLY OR INSTALLATION

If a product appears damaged, defective, or incomplete before assembly, customers should consider stopping assembly and contacting us before continuing.

Damage caused by installation or assembly materially inconsistent with provided instructions may not qualify as a manufacturing defect, subject to applicable consumer protections.

41. PRODUCT RECALLS

If merchandise becomes subject to an applicable recall or material safety notice, customers should follow instructions issued by the manufacturer, supplier, or responsible regulatory authority.

Where appropriate, HomeSpark may take reasonable steps to communicate relevant information to affected purchasers.

42. CUSTOMER ACCOUNTS

If account functionality is available, customers are responsible for maintaining reasonable security over login credentials.

Please contact us if you suspect unauthorized access.

We may temporarily restrict an account when reasonably necessary to protect security or investigate suspicious activity.

43. PERSONAL INFORMATION

Our Privacy Policy describes how information associated with customers and visitors may be collected, used, retained, disclosed, and protected.

Customers should review the Privacy Policy together with these Terms.

44. HOMESPARK CONTENT AND BRANDING

Our online store may contain photographs, product descriptions, graphics, illustrations, logos, trademarks, designs, layouts, written materials, and other protected content.

Such materials may belong to HomeSpark or applicable licensors, suppliers, manufacturers, or other rights holders.

Use of our store does not transfer ownership of these materials.

45. USE OF STORE MATERIALS

Customers may access store content for ordinary personal shopping and informational purposes.

Unless separately authorized or permitted by applicable law, protected materials may not be commercially reproduced, modified, republished, distributed, sold, licensed, or otherwise exploited.

HomeSpark branding must not be used in a manner that falsely suggests authorization, sponsorship, partnership, or endorsement.

46. REVIEWS AND USER CONTENT

Where available, customers may submit reviews, ratings, comments, photographs, suggestions, or other content.

Customers should provide only material they have the right to submit.

User content must not knowingly contain unlawful, fraudulent, infringing, threatening, malicious, or privacy-violating material.

We may moderate or remove submissions where reasonably appropriate.

47. PERMISSION FOR PUBLIC SUBMISSIONS

When content is intentionally submitted for public display, you grant HomeSpark a non-exclusive permission to reproduce, display, format, and use that content in connection with operating and promoting our store, subject to applicable law and our Privacy Policy.

You retain ownership rights you otherwise possess in your original content.

48. THIRD-PARTY SERVICES

HomeSpark may use independent providers for functions such as:

Store technology;
Payment processing;
Communications;
Analytics;
Order fulfillment; and
Shipping.

These providers may maintain separate terms and privacy practices.

To the extent permitted by law, HomeSpark is not responsible for independent third-party conduct outside our reasonable control.

49. EXTERNAL WEBSITES

Our website may contain links to external websites or services.

Providing a link does not necessarily mean that HomeSpark controls, owns, sponsors, endorses, or guarantees that third-party service.

Customers should independently review applicable third-party terms and privacy practices.

50. PROHIBITED STORE ACTIVITY

You must not use our website to:

Commit fraud or conduct unlawful transactions;
Use unauthorized payment information;
Attempt unauthorized access to systems or accounts;
Bypass security measures;
Introduce malware, viruses, or harmful code;
Deliberately disrupt store functionality;
Unlawfully collect information about others;
Infringe intellectual property or privacy rights;
Provide materially deceptive transaction information; or
Assist another person in prohibited activity.

We may restrict access in response to material violations.

51. STORE AVAILABILITY

HomeSpark makes reasonable efforts to maintain reliable online store functionality.

Maintenance, cybersecurity measures, software updates, network interruptions, technical failures, or third-party outages may temporarily affect availability.

Continuous and error-free access is not guaranteed.

52. CHANGES TO HOMESPARK SERVICES

We may add, modify, replace, suspend, or discontinue merchandise, collections, website features, or operational services as our business evolves.

Changes to future services do not eliminate obligations relating to completed purchases or mandatory customer rights.

53. WARRANTIES AND CONSUMER RIGHTS

To the maximum extent permitted by applicable law, our website and digital services are provided on an “as available” basis.

We do not guarantee uninterrupted operation of every website function.

Products may be subject to separate warranties offered by manufacturers or suppliers where applicable.

Nothing in these Terms excludes statutory warranties, consumer guarantees, or other protections that cannot legally be excluded.

54. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, HomeSpark will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of our website or services where such liability may lawfully be excluded or limited.

Any limitation applies only to the extent permitted by applicable law.

Nothing in these Terms restricts liabilities, consumer protections, or remedies that cannot legally be restricted.

55. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify HomeSpark against reasonable third-party claims, losses, liabilities, damages, and expenses arising from your unlawful use of our services, material violation of these Terms, or infringement of another person's legal rights.

This provision does not require you to assume responsibility that applicable law requires HomeSpark to bear.

56. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be limited or severed only to the extent necessary.

The remaining Terms will continue in effect.

57. RESTRICTION OR TERMINATION OF USE

You may discontinue use of our online store at any time.

HomeSpark may restrict or suspend access where reasonably necessary because of fraud, unlawful activity, serious security concerns, substantial misuse, or material violation of these Terms.

Provisions intended by their nature to survive termination remain effective to the extent permitted by law.

58. RELATED HOMESPARK POLICIES

These Terms should be read together with our:

Privacy Policy
Shipping Policy
Return & Refund Policy

These policies supplement the Terms and provide more detailed conditions for their respective subject areas.

59. ENTIRE AGREEMENT

These Terms together with applicable policies incorporated by reference constitute the agreement governing use of the HomeSpark online store and purchases made through it.

Our failure to enforce a provision on one occasion does not automatically waive our right to enforce that provision in the future.

60. GOVERNING LAW

These Terms are governed by applicable laws of the United States and, where applicable, the laws of the State of California.

Nothing in these Terms is intended to waive, restrict, reduce, or eliminate mandatory consumer protections, statutory rights, or remedies available under applicable law.

61. CHANGES TO THESE TERMS

HomeSpark may revise these Terms periodically to reflect changes in our merchandise, business operations, technology, website functionality, policies, or applicable legal requirements.

The updated version may be published through our website with a revised effective date.

Where applicable law requires additional notice or consent regarding a material amendment, we will comply with those requirements.
